The Fine Print
SIGN IN POLICY:
All members will be checked in by the coach on duty before class begins.
Members must arrive to workouts on time. We allow a 5-minute grace period that does not extend past the warm-up. Ultimately, whether or not the member will be allowed to attend the class will be determined by the coach. Members who are allowed to join the class late may be given alternate warm-up or be asked to sit out the skill/strength portion to ensure safety. We value your safety as well as the time commitment of all members and coaches, so we ask that all of our members respect this policy and make every effort to arrive on time, if not early, for class. If a member is consistently late to class and it appears they are abusing the late policy, the member will be asked to leave or attend the next available class of the day.
LATE CANCELLATION POLICY:
You can cancel workouts up to 4 hours in advance and 2 hours in advance for appointments. There is a $15 fee for late cancellations or no-shows, and you will lose your session. This applies to all workouts and appointments. No exceptions.
MEMBERSHIP PLAN RENEWALS
CHANGES AND CANCELLATIONS:
All Session Based Membership plans are paid by (WEEKLY/MONTHLY) – automatic electronic payment (credit card, debit card, or automatic checking account draft). Memberships will automatically renew each period at the same payment terms and billing date established at time of enrollment. All prepaid plans are paid in full upfront and will automatically renew upon expiration at the same rate and terms as the initial membership. Any changes to your membership, including cancellation, must be received 30 days in advance of your next billing cycle or membership expiration date. It is the member’s responsibility to monitor membership expiration and renewal dates.
All memberships require a minimum of 30 days’ notice to assure cancellation of automatic payments and are subject to a $99 termination fee. Cancellation requests submitted within the 30-day billing cycle will result in a final payment drawn from your account on your established auto draft date. Once final payment has been drawn from your account, clients will have 30 days from the last bill date to use the facilities. To cancel your membership, you must submit the cancellation request form on our website and complete an exit interview with your coach. Cancellation notifications presented in any other form, including text message, email, and verbal exchanges, will not be accepted. Failure to follow our cancellation process may result in additional charges. It is your responsibility to provide notice 30 days in advance of your next billing date. There will be no refunds issued once a payment has been charged to your credit card.
MEMBERSHIP UPGRADES AND DOWNGRADES:
All members are welcome to upgrade or downgrade their membership plans or packages without penalty. Memberships can be upgraded at the start of the next billing cycle. However if a member wishes to upgrade immediately their new membership plan will be prorated based on the number of days remaining in their current billing cycle at their new rate. At the start of the next monthly billing cycle, they will be charged at their full membership rate. If a member wishes to downgrade their membership to a lower session-based plan, they must wait until their next monthly bill date for the new plan to be effective. Changes cannot be made retroactively.
ATTENDING MORE SESSIONS THAN
ALLOWED BY YOUR MEMBERSHIP PLAN:
If a member attends more classes than their plan allows in a month, they will be charged a fee of $30 per additional session. For example, if a member has a 9-session per month plan, but attends 12 sessions within their monthly billing cycle, they will be charged their 9-session per month membership fee as well as an additional $90 for the three extra classes attended. Fees for additional classes will be billed directly to the member’s card on file at the end of the month. If a member consistently attends more sessions than their plan allows, we highly recommend that they consider upgrading to a higher session membership for cost savings.
MEMBERSHIP HOLDS AND ACCOUNT FREEZES:
We do not offer temporary membership holds or freezes for any other reason than a medical issue (such as an injury) or military deployment. A member must provide documentation, such as a doctor’s note, in order to effectuate the freeze. The freeze will not exceed a period of 30 days.
REFUNDS AND USE IT OR LOSE IT POLICY:
The Queer Gym will not provide refunds retroactively for any cancellation requests. We timestamp your cancellation request when you submit the cancellation request form on our website. This process is the only acceptable way to notify us of your intent to cancel. Notifications presented in any other form, such as text messages, email, social media posts or messages, or verbal exchanges, will not be accepted. The Queer Gym does not issue refunds if you do not use your membership, nor can you carry over sessions to the next month if you miss a class. No exceptions.
KIDS AND DOG POLICY:
The Queer Gym prides itself on being a kid and dog-friendly gym. But in the interest of keeping everyone as safe and focused on their fitness as possible, we ask that you adhere to these policies regarding children and our four-legged friends. All children and dogs need to be able to sit unattended at the front of the gym. If they require supervision, please have a responsible adult in attendance to supervise them. Our coaches are not responsible for your children or your pets. If your child or pet is being disruptive to other members, please attend to them. Children and pets are not allowed on the equipment at any time (including rings, bumper plates, and boxes), and must be off the gym floor during classes. Please ensure your children or pets do not wander into the back of the gym. Please clean up after your children or pets, including any snacks they may want to enjoy during the class. We pride ourselves on keeping a clean and rodent/pest free environment for our members, and it is also not our coaches’ responsibility to clean up food items. Dogs that bark, whine, jump or bite are not allowed at the gym. Dogs must be on a leash at all times. We reserve the right to ask you to remove a disruptive dog at any time. Our staff is not responsible for your dog or any messes they make. Please always ask management first if it is okay to bring your dog to class; do not assume it is okay without first seeking permission.
We reserve the right to scale or stop your training session if it is deemed unsafe. This particularly applies to Open Gym. The Queer Gym reserves the right to refuse service to anyone for any reason. We reserve the right to cancel a client’s membership at any time for any reason. If your membership is terminated by The Queer Gym for any reason, we will refund the balance or remainder of any prepaid, unused membership.
RELEASE OF LIABILITY
By signing a membership contract, you have enrolled in a program of strenuous physical activity that may include, but is not limited to walking, running, boxing, yoga, aqua aerobics, massage therapy, weight lifting, bicycling, in-line skating and the use of various conditioning and exercise equipment and facilities designed, offered, recommended, provided by and/or supervised by The Queer Gym. By signing a contract with The Queer Gym, you affirm that you are in good physical condition and do not suffer from any disability that would prevent or limit your participation in this program. If your physical condition changes you will seek professional medical advice before returning to The Queer Gym. In consideration of your participation in the program, you, your employees, heirs, assigns, agents, officers, directors, shareholders and co-workers hereby release The Queer Gym, its employees, assigns, agents, officers, directors, and owners, from any and all claims, demands or causes of action arising from you participation in the program or from any use of the conditioning and exercise equipment and facilities. You fully understand that you may suffer injury as a result of your participation in the program and hereby release TPS from any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain and suffering, that may occur by reason of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/ lower back/foot injuries, and any other illness, soreness, or injury, however caused, whether occurring during or after your participation in the program or use of the conditioning and exercise equipment and facilities, regardless of fault.
You have granted The Queer Gym and his/her agents the right to use your name, biographical information, photographs, images, story and/or testimonial, in whole or in part, and without restriction as to changes or alterations. You have granted rights to The Queer Gym, throughout the world and for any purpose whatsoever, including without limitation for marketing and advertising purposes of The Queer Gym, and in any and all media, including without limitation The Queer Gym website. You have acknowledged that The Queer Gym has no obligation to return any photographs or images to you. You have RELEASED, WAIVED and FOREVER DISCHARGED any and all claims arising out of, or in connection with, such use by The Queer Gym, including without limitation any and all claims for libel or invasion or privacy.
